ThinkSport Terms of Service

Status: proposal for the pilot. Not yet reviewed by counsel. The legal operator is still open (specification decision 2).

Version 0.2.0-draft · Effective date 16 October 2026 · Last updated 16 October 2026

1. These Terms

ThinkSport is operated by the operator named in the Imprint ("we", "us"). These Terms govern the use of the web application at app.thinksport.org, the MCP endpoint at app.thinksport.org/mcp and the ThinkSport plugins for Claude, ChatGPT and other MCP clients (together the "Service").

Before accessing your workspaces or connecting an AI assistant, you must accept these Terms and acknowledge the Privacy Policy. We record your account, the document versions and hashes, the source and the time of acceptance. If we update either document, you must acknowledge the current documents before continuing.

2. The Service

The Service keeps the governed continuity record of sport-innovation programmes: organisations and people, programmes and their data policies, participations, mentor assignments, follow-ups, needs, capabilities, evidence, decisions and lessons. Through the standing ThinkSport Exchange programme it also supports discovery, staged introductions and collaborations between organisations that take part.

The Service sends no messages, publishes nothing and takes no consequential action on its own. Consequential changes are previewed and need your explicit approval. Participation in a programme, a role or a search result is never an endorsement, approval or recommendation by ThinkSport.

3. Accounts, workspaces and programmes

You need a verified email identity. ThinkSport provisions workspaces for organisations; the first owner accepts a single invitation, and the workspace's owner then controls its members, its exchange participation and its disclosures. A programme participation or mentor assignment gives access only to that programme's records as its data policy allows, never to a workspace.

Programme hosts are responsible for their programme's data policy, notices, lawful bases and the agreements with other parties that the policy names. Participants acknowledge the notice and decide their own optional choices.

4. Your content

You keep all rights to the content you store. You grant us the licence needed to host, process, secure and maintain the Service for you. You are responsible for having the right to store and release what you record; store a source reference rather than a document, and keep data your programme excludes out of the Service.

5. Discovery, introductions and collaborations

Records are discoverable only while your organisation takes part in the standing Exchange programme with its discovery choice active, and only the field groups you release to the stated recipient classes or named organisations. An introduction releases exactly the fields shown in its preview to the named recipient. Withdrawing a release stops future access but cannot recall what the recipient has already read. The Service records collaborations and rights clearances but does not draft, interpret or enforce any agreement.

6. Acceptable use

Do not use the Service to send unlawful communications, to process data you may not provide, to disclose confidential information without authority, to profile athletes, to coordinate between competitors, to present participation as endorsement, or to interfere with the Service or other users.

7. Fees

The Service is free of charge. It has no plans, quotas or payment, and asks for no payment details.

8. Your AI assistant

Everything you read through the Service is processed by the AI assistant you connect, under that provider's terms. We recommend a business account with model training turned off. A programme may restrict which assistants can read its records.

9. Learning exchange

Private workspace data is required to operate the Service. Shared learning is a separate purpose. Only the workspace owner may decide that the workspace takes part, after seeing what is shared, what is excluded and how withdrawal works. Each contribution needs its own approval and shares only allowlisted, normalised categories, never lesson text, sources, identities, contacts or personal data. Two different ThinkSport operators approve every aggregate release, which is suppressed when it fails the published controls. Withdrawal stops all new use and future releases at once; an aggregate already released cannot be recalled. Contributions are not used to train a general-purpose model.

10. Availability and changes

The Service is provided during the pilot without an availability commitment. We may change or discontinue features with notice where practicable.

11. Liability

To the extent permitted by law, our liability is limited to intent and gross negligence. We are not liable for indirect damages or lost profits.

12. Termination

You may stop using the Service at any time and export your workspace. We may suspend a workspace's Exchange access for a material breach, a security incident, a dispute or at the organisation's request; its private records stay readable.

13. Governing law

Swiss law applies. The courts at the operator's seat have jurisdiction, subject to mandatory consumer protection rules.
